Terms of Service

These terms govern your use of Tapback, the live-reactions service at tapback.party. Tapback is operated by Ross Duggan, a sole trader based in Ireland ("we", "us"). You can reach us at hello@tapback.party. By creating an account or embedding Tapback on a site, you agree to these terms.

1. The service

Tapback lets you add a live reaction bar to your web pages with a script tag. We host the infrastructure: reaction counts, real-time delivery to viewers, the configuration console, and the API. What each plan includes — reaction kinds per bar, number of bars, daily reaction caps — is listed on the pricing page, which forms part of these terms.

We may suspend or terminate accounts that break these rules. For anything short of deliberate abuse we will contact you first.

6. Your content

Artwork and text you upload (custom reaction icons, Tapbar names, logomark replacements) remain yours. You grant us the license needed to store it and serve it to your pages' visitors — that's the whole use. You confirm you have the rights to whatever you upload.

7. Your data and leaving

You can export your reaction data — configuration and full daily history, as JSON or CSV — from the console at any time, and you can generate a static archive that keeps your final counts rendering with no further calls to us. To delete your account and its data, email hello@tapback.party. How we handle personal data is described in the privacy policy.

8. Service quality

Tapback runs on Cloudflare's network and we work to keep it fast and available, but it is provided as-is, with no uptime guarantee or SLA. Counts are engagement signals with documented integrity bounds; they are not audited ballots, and you shouldn't present them as such.

9. Liability

To the extent Irish law allows: we are not liable for indirect or consequential loss, and our total liability for claims arising from the service is capped at the amount you paid us in the 12 months before the claim (or €50 if you pay nothing). Nothing in these terms excludes liability that cannot be excluded under law, and if you use Tapback as a consumer, your statutory rights are unaffected.

10. Changes to these terms

If we change these terms in a way that matters, we will email account holders at least 14 days before the change takes effect. Continuing to use Tapback after that is acceptance; if you don't accept, cancel and we will refund the remaining term of a paid plan pro rata.

11. Governing law

These terms are governed by the laws of Ireland, and disputes belong to the Irish courts. If you are a consumer in the EU or UK, you keep any mandatory protections of your home country's law and may bring proceedings there.
